Terms and conditions

Terms and conditions   Top of page

1. GENERAL

1.1 These terms and conditions explain your rights and obligations in relation to this website and any items purchased through this site. They also explain how we operate and include details of how to purchase from us, our delivery procedures, and our replacement, refund and returns policies, in the event that you have any problems. It also covers our privacy policy and details about us. Please read them carefully.
1.2 You may have other rights granted by law and these terms do not affect these rights. If there is anything you do not understand, then please contact us via the form on the "Contact us" page.
1.3 We comply with the DTI Consumer Protection (Distance Selling) Regulations 2000.

2. PURCHASING FROM US

2.1 To purchase from us you need to be resident in England, Wales or mainland Scotland. We cannot ship to locations outside the British mainland.
2.2 All prices quoted are in British pounds. The cost of delivery for your order is clearly shown in you cart, and on your order confirmation. This cost includes all carriage, packaging and any insurance costs.
2.3 As soon as your payment has been processed and accepted, you will receive an order confirmation by e-mail. We recommend you check this carefully as soon as you receive it.
2.4 Most of the items that you might purchase from us are ex-stock lines - these include most products on our site. In accordance with the DTI (Distance Selling) Regulations 2000, you are entitled to receive these, inspect them and return them for a refund up to 14 days after receipt.
2.5 You can, of course, add to your order at any time by placing another order with us; however, this second order may not be delivered at the same time as the first order and will incur an appropriate delivery cost.
2.6 By submitting your order to us, you are offering to buy the goods; by sending you the order confirmation we are confirming that we will supply the goods ordered at the price agreed.
2.7 Payment must be by debit or credit card. Your payment details will be taken via the Paypal system which ensures total privacy and security of your payment card details.

3. PRODUCT AVAILABILITY

3.1 Unless we contact you, we always supply exactly what has been agreed and what you have ordered. If we are unable to do this, because of availability or a change in the specification by our supplier, we will always contact you before proceeding with your order. If you are not entirely happy with any change we recommend, you can request a full refund immediately.

Deliveries   Top of page

4. DELIVERY

4.1 Delivery can only be made to the address of the payment card holder. All deliveries made by our carriers will require a signature before the goods can be left. If your delivery address is hard to find, please forward details to us to help the delivery driver via the form on the "Contact us" page or the email address notified in your order acknowledgement. We cannot be held responsible for any consequential expenses if delivery is delayed.
4.2 All items on your order will be delivered together. Delivery is normally between one and two days but please allow up to ten days for specialist fixings or spare parts. For periods that include Bank Holidays (especially Christmas), please allow up to three weeks.
4.3 Please note that, occasionally problems occur beyond our control, such as major delays on the roads, floods and extreme weather, vehicle breakdowns, etc. So the delivery time scales cannot be guaranteed.
4.5 The delivery charges for your order are clearly shown in both your cart and your order confirmation. Shipment will usually be by carrier. Sometimes orders for a few small items may be deliverable by post.

Returns Policy   Top of page

5. REPLACEMENT AND RETURNS POLICY

5.1 Please check your order as soon as it arrives, to ensure that you have all the items ordered and that they are all in good condition. Please unpack them carefully to avoid any damage to retail packaging and the product within. If there are any shortages or if any products are damaged, please notify us within 7 days. Failure to notify us within this period may negate your right to make a claim.
5.2 If you notify us of any shortages we will check against the carrier's delivery manifest and send out the missing products to you as quickly as possible. There will be no additional delivery charge.
5.3 Should you consider any of the items to be substandard or damaged, please re-wrap them in the packaging provided and notify us immediately. This must be done before you carry out any work with them. We will replace these free of charge as quickly possible. There will be no delivery charge.
5.4 We reserve the right to inspect the faulty items sent to you before replacing them. We will arrange to collect them from you.
5.5 Should any of the items not meet with your approval, you have the right to return them to us for a full refund, provided you do so within 14 days of receipt. This is in accordance with the DTI Consumer Protection (Distance Selling) Regulations 2000. Should you wish to do this, contact us via the form on the "Contact us" page or via the email address notified in your order acknowledgement, to obtain a goods return number and the returns address. Then please pack them carefully - so that they do not get damaged in transit - and return them to the address given with the returns number clearly shown. In these situations, ToolFest does not pay the return carriage costs.
5.6 You will be refunded in full as soon as we have received the unwanted items back and inspected them to ensure that they are in a re-saleable condition. Please note that it is your responsibility to ensure that they do arrive at our premises in this condition.
5.7 Once you have successfully used the products purchased, it is extremely unlikely that any of the items ordered would subsequently develop any fault. Of course, with time, they will show signs of wear and tear; this is to be expected. But if they develop a fault and you believe that this fault is of such a nature that it must have been present when the goods were delivered to you (i.e. not just showing signs of wear and tear), then please contact our complaints department via the form on the "Contact us" page. You will probably be asked to return the faulty item to us for us to inspect it. Where appropriate, we will probably offer to repair your existing product, or replace it or offer a partial refund, depending upon the length of time that you have had the product.
5.8 In the event that you wish to claim against ToolFest for whatever reason, please note that the limit of our liability is the value of the goods supplied. We do not pay compensation for any other factors.
